WAR (WE ARE RATIONAL) AGAINST THE IMPLEMENTATION OF EO 366 – QUEDANCOR Employees !!!

Background:

As a whole, Quedan and Rural Credit Gurantee Corporation (QUEDANCOR) has a mandate to provide accessible and affordable credit to agri-industry sector guided by its charter Republic Act 7393. Performances show the continuous better social service throughout the whole nation for more than 30 years being a self-reliant Government Owned and Controlled/Government Financing Institution (GOCC/GFI) – without the provision of the annual General Appropriations Act (GAA). Generated about 47 billion pesos of loans to various individuals, partnerships, associations, cooperatives, and others benefiting more or less 5 million Filipinos nationwide.

Part of this mandate is to create branches or offices in every region and provinces. Majority of offices were formally established almost seven (7) years ago. This office is required to provide credit services covering the whole provinces. On its peak of operations, there are 1,600 employees being hired by the management to implement various programs. Eventually, when QUEDANCOR was involved in swine scandal, it seemed that it will be deactivated on the time that majority of its employees (about 700 employees) were forced to resign and look for a much sustainable work to earn for a living. Today, there are only 900 employees doing multi-task function that cater to clientele needs - In fact, there are no redundancies in our functions!

Some District Office has generated approximately more than 500 million of loans benefiting more or less 10,000 individuals. We provide services as far as Islands, Peninsulas, Mountains and other remote areas of the Philippines.

July 1, 2009 – Implementation of Rationalization Plan:

At least 600 employees of the QUEDANCOR are directly affected by the implementation of Executive Order 366. There is no assurance for this number of employees where they will be placed once this policy is implemented.

Only 258 employees will be retained to the QUEDANCOR based on the Rationalization Plan recently approved by the board.

The present set-up of offices will be integrated into one Area Field Office (AFO) per cluster/megaregion requiring only 31 employees. How does this number can perform well of their tasks, considering the present situation doing a multi-task function? Just for example, cluster #2 which includes the National Capital Region, Southern Tagalog Region and Bicol Region with approximately 15 offices and about 150 employees will be streamlined into one AFO as Sto. Tomas, Batangas as the place of office.

Impractical, not revelant solution on this time of Global Economic Crisis:

IMPRACTICAL the management, government and community will not get bottom line benefits. It may costs less in essence, may be less operating expenses to be incurred, but this may also result to huge amounts of past dues/overdues and problematic accounts based on current portfolio – which is designed or programmed requiring more labor. This will displace great number of employees. This is a violation of QUEDANCOR mandate which states that this will provide accessible and affordable credit to agri-industry. This is may be for the benefit of the few, particular for those who will be granted the increase of salary! This is impractical and not relevant decision of the management.

NOT RELEVANT the government gave the assurance that no single government employee will be laid off in this time of global economic crisis and also issued two executive orders, EO 782 and EO 783 INSTITUTING MEASURES TO ASSIST WORKER AFFECTED BY THE GLOBAL FINANCIAL CRISIS AND TEMPORARY FILLING UP OF VACANT POSITIONS IN THE GOVERNMENT, PROVIDING FOR EMPLOYMENT INTERVENTIONS TO SAVE AND CREATE JOBS AS PART OF THE ECONOMIC RESILIENCY PLAN respectively. And all other government agencies under the executive branch are suspended in the implementation of Rationalization Plan.

" Mas masahol pa sa mga nagnakaw na kumuha ng posibleng dagdag na benepisyo para sa mga empleyado ang inityatibang ito, ito ang tuluyang kikitil sa kabuhayan at pag-asa ng mga kawani na matagalang nagsilbi kasama ng mga pamilya na dito’y umaasa."

NO TO STREAMLINING OF GOVERNMENT EMPLOYEES !!!
FIGHT FOR GOVERNMENT WORKER’S RIGHT !!!

Kahit pa nga siguro malapit sa 100% repayment na sinasabi ni NCB di pa rin kaya bayaran ang utang, dahil may MOOE pa. Ay naku, nun pang nagsiupo si NCB at mga alipores niya mali mali na ang mga pinagagawa, kaya nun pa pabagsak na tayo.

ask ko lang po kung "uniform percentage" ang salary rates how come my regular/permanent co employee still enjoys his step 7 salary? for casual employees lang po ba ang un section 5 ng EO 811?

Magandang araw sa lahat!

Salamat sa Quedancor/CO sa P1k at Xmas bonus, gayundin sa sa Quemas sa P300.00.

Tayong naka-survive sa typhoons ay maraming dapat ipagpasalamat.

Yun nga palang nag-sabing "donya" ako, hayan tuloy wala akong monetization kahit na nag-file ako...o baka delayed lang yung aking monetization.

Bilib ako dun sa mga apektado ng bagyo na hindi nag-monetize ng leave.

By year 2010, bagong taon, bagong hamon na naman ang ating haharapin. Kasi til December 31, 2009 lang po ang ating mga kontrata.

Itong November balik na po ako sa Regional office sa Dagupan City as verbally announced by RO 1's acting RAVP in the three meetings that she had. Actually tatlo po kami from district offices na ma-transfer sa Dagupan office.

Region 1 is still doing it's best to collect and remediate to sustain whatever funds the corporation have.

Sana mag-kaisa ang lahat, lalo na po sa Central office para maganda po ang pasok ng 2010 sa atin.

Advance Halloween po sa lahat at ipagsasal natin ngayong All Saints and All Souls Day ang mga nauna ng namayapa sa atin.

first of all congratulations to madam j. martin for being now the number 2 in quedancor and most powerful, influential and dangerous official re implementation of rat plan. expect na may pwesto rin ang kanyang......(lam nyo na un) and they will live hapily he he he. pity to those afected employees like me.pa submit p daw kayo ng PDS pero meron naman na kayong tao n ilagay. sana ibigay agad ung mga benefits para maka pagsimula. by the way nasaan na kayong mga quemas officers? this is the time to fight our rights, nilalansi na tayo ayaw nyo pang kumilos. sabi ng management mahirap na daw tayong umahon, so dapat minsanan na ang pagsara para mging patas ang laban.

If this is the last time I am with QUEDANCOR,

Thank you for the past seven years, seven years of learning, friendships, and being one as a family. Before when I heard that anytime I will be separated in this company I feel I am lost, I cry and their was a bitterness and revenge on my part. I always asked WHY????
I am lost because I don’t know where to go, I cry because I am thinking how do we live if I lost my job, I am bitter because I know somebody does it for their own benefits, I want to revenge to those who want this to happen.
As times goes by and as I realize and as I surrendered myself to GOD, I know that I will not lost my life just because I am losing my jobs. I am not crying because I have no regrets of choosing to be part of this institution because I learned and I know I am a big part of the growth of this company. I am not bitter to the people who make this happen and I don’t want to revenge over them. I am not GOD to judge them that they were wrong and if they were, only GOD can make them realize.
We are professional enough, we know what is right and wrong, we also know what is ethical and what is not. As long as we knew that we do things right and we do it ethical in accordance with all of the laws created by man, THE TEN COMMANDMENTS, WE SHOULD NOT BE WORRY OF TOMMOROW, EVERTHING WILL BE ALRIGHT AND EVERY WILL PUT ON THE RIGHT PLACE AND ON THE RIGHT TIME.

Dear Chairman Melo,

We the employees of Quedancor Pangasinan District Office write in behalf of Quedancor Region I. As the national election approaches, we are aware of your very busy schedule and the gargantuan work that needs your time and attention. In spite of that, we are hoping and praying that you accommodate us by reading our letter. Knowing that you are a stalwart of justice and equality, we strongly believe that you will heed our grievances and concerns.

This is a revised version of the letter dated February 17, 2010 drafted by our colleague Mr. Melvin P. Matabilas of Quedancor – Caraga. Incorporated is an update regarding a recent memo issued by the Change Management Committee Chairman, which if implemented would constitute a GROSS VIOLATION and DIRECT CONTRADICTION of the Omnibus Election Code concerning an employee’s transfer during the election period and moreover of the Civil service ruling regarding reassignment of an employee.

Last February 5, 2010 our RATPLAN was approved wherein the current 260 permanent positions was reduced to only 191 and the remaining 707 casual and contractual positions would be abolished,. Likewise, the vital function of the 15 Regional Offices and 78 District Offices would be contained and assigned to 5 Area Offices nationwide.

Mr. Espiritu has openly express of his intention to implement this before March 26, 2010, which is the ban on hiring and promotion. He knows that this would surely pose a legal technicality since regular employees are afforded the right under Sec. 13 (e) of the Implementing guidelines of EO 366, which states that, ‘ Incumbent of positions in functions, programs, projects and units that are affected, if with permanent appointment shall be given two (2) months within which to decide whether to remain in government service or avail of the retirement/separation benefits…’ If we recon the counting from the date of approval of the RATPLAN which is February 5, 2010, two (2) months after would fall on April 5, 2010.

Despite of the above-stated provision Mr. Espiritu issued memo No. 067 on February 9, 2010 requiring the regular employees to state on or before February 15, 2010 whether;

(a) they opt to remain in government service or

(b) avail of the incentives as provided for in EO 366

Furthermore, failure to reply on or before the set deadline would be construed of the concerned employees’ intent to avail of the incentive under EO 366. Adding more insult to the injury, the Change Management Committee Chairman, whom Mr. Espiritu also appointed, issued a memo dated February 18, 2010, informing Miss Shiela E. Posadas an employee of region I that her new assignment would be in region VII. Taking into consideration the proximity of the two regional offices, the transfer if implemented strongly violates the Omnibus Election Code since the Change Management Committee obviously intends to implement the transfer within the election period. This is also a grave violation of the rights of civil servants. Former Chair Karina C. David said in one of her speeches about Rationalization of Government Agencies, that if ever a state employee is to be transferred, he/she can only be transferred within his/her region, so as to prevent massive geographical dislocation, in this particular case, it would be Region 1.

We have unanimously agreed that we will appear in court to testify that the reassignment of Miss Posadas and others were done with the prejudiced and discrimination.

The Change Management Team are composed of people whom Mr. Espiritu handpicked himself, although there is a member representing the employees union, each 15 regions should have been represented and given a part in the selection process. That way transparency which is one of the guiding principles in the rationalization would be enforced. The exclusion of any representative coming from the regional offices has cast doubts of maneuvering in the selection process.

Mr. Espiritu’s financial presentations revealed that the corporation has still P7.3 billion amount of receivables, of which P2 billion is the conservative amount to be collected in five (5) years. We deemed that with the P2 billion worth of receivables Mr. Espiritu need not rush the implementation of the RATPLAN. That amount translate to a collection of P400 million per annum. This is sufficient enough for us to survive the whole year of 2010. We humbly urged him to postpone the implementation until the election period is over, that would give us ample time for the implementation of all the IRR provided in EO 366 and with no legal impediments to hurdle.

Mr. Espiritu had admitted, that prior to his “rush” implementation of the RATPLAN, some congressmen reminded him not to “fast-tract” the Rationalization of Quedancor, since Quedancor’s charter is being reviewed in congress and there has been no reduction of the approved annual budget.

Despite of all these efforts to dissuade Mr. Espiritu from fast-tracking the implementation of the RATPLAN, and with the limited time to implement all the mitigation strategies, pay separation incentives and to coordinate with GSIS to return employees’ contribution, it seems that against all odds he is bent on doing so, before March 26, 2010.

Sir, we the Quedancor employees of the solid North humbly seek your intervention for a favorable action. We plead that you would NEVER allow an exemption to the request of Mr. Espiritu. His request and actuations have brought low morale and desperation among employees. But despite of that we are continuously working for the corporation’s survival beyond the 2010 election with the hope and renewed confidence that the next President of the Philippines would also share the same policies as that of Her Excellency Gloria Macapagal –Arroyo.

Expect more letters to flood your office coming from different regions also pleading that NO EXEMPTION WILL BE ACCORDED TO MR. ESPIRITU.

It is was not written to discredit the credibility of our president Mr. Federico Espiritu but to exercise our right to freedom of speech. All I am asking is RESPECT THE TOTAL ELECTION BAN, nothing more, nothing less. I do believe that EXEMPTION is not a SOLUTION.

Revamp in Philippine's State Credit Firm Raises Uproar

MANILA – There is trouble brewing inside the Quedan and Rural Credit Guarantee Corporation (Quedancor), one of the Philippine government’s more important lending institution that cater to agricultural and countryside loan requirements.
Regular state employees affected by the planned rationalization of the lending institution have already raised a howl against the streamlining, calling the move, which is pushed firmly by newly-installed Quedancor president Federico A. Espiritu, contrary to the social justice principle enshrined in the 1987 Constitution.
In a letter dated February 5, 2010, Budget and Management secretary Rolando G. Andaya Jr. approved the rationalization plan at Quedancor, saying the plan is in line with Executive Order No. 366 and its Implementing Rules and Regulations, and Memorandum Order No. 190.
But the affected employees cried foul.
Four days later, in an apparent haste, Espiritu issued Memo No. 067 addressed to “all regular employees” notifying them of the impending revamp and required them to reply within six days from the issuance of the memo, which is in violation of Section 13(e) of EO 366 that gives employees two months “to decide whether to avail of the incentives [under the Order] or not.”
Under Section 5 of EO 366, the approval of the DBM of the rationalization plan would only be construed as a “review” but the final approval still falls on the President, a responsibility, the affected Quedancor employees said, Espiritu has started to usurp.
One of the contentious highlights in the DBM letter was the reduction of the number of departments in Quedancor from seven to five, the divisions from 20 to 11, and the regional offices from 15 to five area field offices.

Actually, the plan to streamline Quedancor started in 2009 while Espiritu was still the agency’s office-in-charge, but it was only aggressively pushed after he was given the permanent appointment as president of Quedancor towards the end of last year.
Earlier, in support of the state employees that would be affected by the revamp, Rep. Philip A. Pichay of Surigao del Sur wrote Espiritu asking “the basis for the [planned] dismissal,” citing that the agency’s budget for 2009 “has not been reduced, hence it cannot be a rationale for the purported layoffs.”
Citing the government’s employment initiatives, the lawmaker also labeled the proposed retrenchment as running “smack against the thrust of President Arroyo to create jobs for the people.”
The approved rationalization plan, which will affect all Quedancor offices nationwide, first got its strongest resistancen from the regular employees in Caraga Region and Region VII.
In a display of dismay, the Quedancor employees wrote an appeal to President Gloria Macapagal-Arroyo, expressing their apprehension that given the global economic crunch they would not be able to find another job if displaced.
While the threatened state employees have not asked for Espiritu’s removal, Palace insiders supportive of the personnel’s plight have expressed optimism the Quedancor revamp would not happen, implying that the agency’s president would suffer the same fate as that of the recently replaced secretary of environment and natural resources.
The Palace insiders were referring to the removal of Eleazar Quinto, the shortest-reigning DENR secretary, who was replaced by then Mines and Sciences Bureau director Horacio Ramos after the former made drastic moves to streamline the department.
Quinto, son-in-law of Arroyo adviser Lupita Aquino Kashiwara and first-degree cousin of Sen. Benigno S. Aquino III, was later reassigned to the Presidential Coalition Affairs Office (PCAO), an obscure Palace agency.

I’ve worked with Quedancor for so long. Earned every penny’s worth and enjoyed my work and the company of my peers. Seen how some people use, if not abuse, co workers and subordinates. Use the office for their personal advantage and more. Work with and under some executives. Got to know their capabilities and short comings. Many of whom hold positions not appropriate with their abilities, much more, trying to project a person with so much proficiency in such field as many of them were only given positions as gratitude from the former president. The wiser ones take hold of the knowledgeable and hardworking personnels, while others get to rely with or given the run around by their clever staff.

The events unfolding now, saddens me as many of the hardworkers and knowledgeable people would be displaced while much of the executives, who expertly contributed to the company’s mess will be retained or allowed to receive their fat separation packages.

The way I see it, this move to rationalize at this time is administration’s way of silencing the clamor for justice for Quedancor, the Corporation. As we all know, the mishandling of the corporate affairs goes from the executives up to the Board of Directors as approving authorities. Limiting the corporation’s functions and manpower is an alternative to closing down the company which would otherwise need congressional act to effect. A smaller unit would mean less finger pointing in an event a new government would care to look into what really happened with the country’s premiere agri-credit facilitator.

Getting rid of the abled casuals and some regular positions is not the solution to making the company rise once more. Kicking out and replacing those unfit executives and staff is! Leave the performing and knowledgeable ones and we will be doing great service to our constituents.

With the current rationailization in the making, I feel better off outside the company as I sense the change would not be for the better. Worst is, being slave worker for some dumb asses!

I’m not a saint. I’ve tried as much, to be a good public servant, but the current environment within would push anybody to his lows.

Section 1. It is hereby declared the policy of the State to protect the security of tenure of civil service officers and employees in the reorganization of the various agencies of the National Government and of local governments, state colleges and universities expressly authorized by law, including government-owned or controlled corporations with original charters, without sacrificing the need to promote morale, efficiency in the civil service pursuant to Article IX, B, Section 3 of the Constitution. chan robles virtual law library

Sec. 2. No officer or employee in the career service shall be removed except for a valid cause and after due notice and hearing. A valid cause for removal exists when, pursuant to a bona fide reorganization, a position has been abolished or rendered redundant or there is a need to merge, divide, or consolidate positions in order to meet the exigencies of the service, or other lawful causes allowed by the Civil Service Law. The existence of any or some of the following circumstances may be considered as evidence of bad faith in the removals made as a result of reorganization, giving rise to a claim for reinstatement or reappointment by an aggrieved party:

(a) Where there is a significant increase in the number of positions in the new staffing pattern of the department or agency concerned;chan robles virtual law library

(c) Where incumbents are replaced by those less qualified in terms of status of appointment, performance and merit;

Sec. 3. In the separation of personnel pursuant to reorganization, the following order of removal shall be followed:

(c) Employees holding temporary appointments; and chan robles virtual law library

Said application shall be considered by the Committee in the placement and selection of personnel.

Sec. 7. A list of the personnel appointed to the authorized positions in the approved staffing pattern shall be made known to all the officers and employees of the department or agency. Sec. 8. An officer or employee who is still not satisfied with the decision of the appointing authority may further appeal within ten (10) days from the receipt thereof to the Civil Services Commission which shall render a decision thereon within thirty (30) days and whose decision shall be final and executory.

Sec. 9. All officers and employees who are found by the Civil Service Commission to have been separated in violation of the provisions of this Act, shall be ordered reinstated or reappointed as the case may be without loss of seniority and shall be entitled to full pay for the period of separation. Unless also separated for cause, all officers and employees, who have been separated pursuant to reorganization shall, if entitled thereto, be paid the appropriate separation pay and retirement and other benefits under existing laws within ninety (90) days from the date of the effectivity of their separation or from the date of the receipt of the resolution of their appeals as the case may be: Provided, That application for clearance has been filed and no action thereon has been made by the corresponding department or agency. Those who are not entitled to said benefits shall be paid a separation gratuity in the amount equivalent to one (1) month salary for every year of service. Such separation pay and retirement benefits shall have priority of payment out of the savings of the department or agency concerned.

Sec. 12. The Civil Service Commission shall promulgate the necessary rules and regulations to implement the provisions of this Act.

Sec. 13. All laws, rules and regulations or parts thereof, inconsistent with the provisions of this Act are hereby repealed or modified accordingly. The rights and benefits under this Act shall be retroactive as of June 30, 1987.

It was covered by ABS- CBN and GMA regional networks, Aksyon Radyo also gave us an air time.

Local media here in Pangasinan/Region 1 have been giving us so much media mileage.

This morning a reporter from a local newspaper (The Island) came to the office and interviewed us again. I WILL POST THE VIDEO ON YOUTUBE AS SOON AS IT'S AVAILABLE.

Our "peacefull and silent" (meaning non-violent) rally and protest got a VERY POSITIVE RESPONSE, from media, clients, and the public in general.

MEDIA : We have exposure in TV, radio and print.

Clients/borrowers have been so concerned about us. Some were very vocal in saying that they sympathize with us.

A friend from BIR said that they too have RATPLAN but theirs is not yet signed/approved by the president. Same goes true with DENR, I have relatives working in DENR. Accordingly, their heads RESPECTS THE ELECTION BAN.

Knowing that people around us supports us, it gives us inspiration to work harder and keep on going.
